Welcome to the Avani Affiliate Program! By signing up and participating in our program, you agree to these terms and conditions. These terms are designed to protect both you (the affiliate) and Avani (the brand), ensuring a successful and transparent partnership.

Please read these terms carefully. If you do not agree with any part, you should not participate in the Program.

1. Eligibility to Join

1.1. You must be at least 18 years old to participate in the Program.

1.2. Your website, blog, or social media platform must align with Avani’s values of sustainability, purity, and non-toxic living.

1.3. Avani reserves the right to approve or deny any affiliate application at its sole discretion.

2. Enrollment Process

2.1. To join the Program, you must complete the affiliate application form on our website.

2.2. Upon approval, you will receive a unique affiliate link to track your referrals.

2.3. Avani may revoke approval if your platform is later found to violate the eligibility criteria.

3. Commissions

3.1. Commission Rates: 10% to 15% commission 

3.2. Commissions are calculated on net sales, excluding taxes, shipping, and discounts.

3.3. Bonus Incentives: Earn an additional 5% commission if your total monthly sales exceed $1,000.

3.4. Commissions are tracked using your unique affiliate link. Failure to use the link correctly may result in missed or invalidated commissions.

4. Payment Terms

4.1. Payments are processed monthly via Paypal or Venmo once you meet the minimum payout threshold of $50.

4.2. If your account does not meet the threshold, the balance will roll over to the following month.

4.3. Affiliates are responsible for providing accurate payment details. Avani is not liable for delayed or failed payments due to incorrect information.

5. Affiliate Responsibilities

5.1. Affiliates must:

• Promote Avani products ethically and authentically.

• Use their unique affiliate link for all referrals.

• Comply with FTC guidelines (see Section 6).

5.2. Affiliates must not:

• Use Avani trademarks, logos, or copyrighted materials without written permission.

• Engage in spam, unethical marketing practices, or misleading promotions.

• Promote Avani products on inappropriate or offensive platforms.

5.3. Affiliates are responsible for ensuring their content aligns with Avani’s values and brand standards.

6. FTC Compliance

Affiliates must comply with Federal Trade Commission (FTC) regulations to ensure transparency and honesty in promotions. Key requirements include:

6.1. Disclosing your affiliate relationship clearly and conspicuously in all content promoting Avani products.

6.2. Using direct language such as:

• “As an Avani affiliate, I earn from qualifying purchases.”

• For social media, use hashtags like #Ad, #Affiliate, or #Sponsored.

6.3. Placing disclosures near affiliate links or product endorsements, where consumers can easily see them.

Failure to comply with these guidelines may result in termination from the Program.

7. Prohibited Activities

Affiliates may not:

7.1. Engage in any form of fraudulent activity, including misrepresenting products or creating fake reviews.

7.2. Use paid advertising to promote Avani products without prior approval.

7.3. Place affiliate links in spam emails, comments, or any content deemed low-quality or irrelevant.

8. Termination of Agreement 

8.1. Either party may terminate this Agreement at any time by providing written notice.

8.2. Avani reserves the right to terminate an affiliate’s participation immediately for:

• Violating these terms.

• Engaging in unethical practices.

• Failing to comply with FTC guidelines.

8.3. Upon termination, affiliates will no longer earn commissions, and their affiliate link will be deactivated.

9. Modifications to the Program 

Avani reserves the right to modify or discontinue the Program at any time, including commission rates, terms, and bonuses. Affiliates will be notified of any changes, and continued participation in the Program constitutes acceptance of the updated terms.

10. Limitation of Liability

Avani is not liable for any indirect, incidental, or consequential damages arising from your participation in the Program. Affiliates agree to indemnify and hold Avani harmless for any claims or disputes resulting from their promotional activities.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of MN, USA. Any disputes arising from this Agreement will be resolved in the courts located in MN, USA.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and Avani regarding the Affiliate Program and supersedes any prior agreements or understandings.

By signing up for and participating in the Avani Affiliate Program, you acknowledge that you have read, understood, and agreed to these terms and conditions.

At Avani, transparency and honesty are core to our values. To ensure our affiliates uphold these principles and comply with Federal Trade Commission (FTC) regulations, we have established the following guidelines:

1. Purpose of FTC Guidelines

The FTC requires all affiliates to disclose their relationship with brands they promote. This ensures consumers understand that you may earn a commission from sales generated through your content.

2. Key Requirements

2.1 Clear Disclosure

• Affiliates must disclose their relationship with Avani in any content where they use affiliate links or promote our products.

• Use clear, direct language such as:

• “This post contains affiliate links. I may earn a commission if you make a purchase through these links.”

• “As an Avani affiliate, I earn from qualifying purchases.”

2.2 Placement

• Written Content (Blogs/Websites): Place the disclosure at the top of the page or post, before any affiliate links or endorsements.

• Social Media: Include the disclosure within the main caption (not hidden in a comment or a “read more” section). Use hashtags such as:

• #Ad, #Affiliate, or #Sponsored.

• Video Content (YouTube, Instagram Stories, TikTok): Disclose verbally at the beginning and display visually on-screen.

2.3 Honesty in Promotions

• Affiliates must not make false claims about Avani products.

• Only promote products you have genuine knowledge of or experience with.

• Do not imply results or benefits that cannot be substantiated.

3. Avoiding Common Violations

• Do not shorten affiliate links without providing disclosure.

• Avoid vague hashtags like #ThanksAvani or #Partnership without a clear explanation of the affiliate relationship.

• Do not place disclosures in hard-to-find areas, such as the bottom of a post or a separate disclosure page.

4. Monitoring and Enforcement

To ensure compliance:

• Avani reserves the right to monitor affiliate content.

• Affiliates found in violation will be required to correct their content immediately.

• Repeated violations may result in removal from the Affiliate Program.
